                                     AN ACT

     1  Amending the act of December 4, 1996 (P.L.911, No.147), entitled
     2     "An act providing for registration requirements for
     3     telemarketers and for powers and duties of the Office of
     4     Attorney General," providing for a "no sales solicitation
     5     calls" list.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of December 4, 1996 (P.L.911, No.147),
     9  known as the Telemarketer Registration Act, is amended by adding
    10  a section to read:
    11  Section 5.1.  "No sales solicitation calls" list.
    12     (a)  List.--Any residential telephone customer desiring to be
    13  placed on a "no sales solicitation calls" list may notify the
    14  Office of Attorney General and have his telephone number placed
    15  on the list upon receipt by the Office of Attorney General of an
    16  initial listing charge of no more than $10. By having his
    17  telephone number placed on the list, the customer will be
    18  indicating that he does not wish to receive unsolicited


     1  telephone sales calls.
     2     (b)  Update.--The Office of Attorney General shall update its
     3  "no sales solicitation calls" list quarterly and provide the
     4  list for a fee to telemarketers upon request.
     5     (c)  Deposit of fees.--All fees imposed pursuant to this
     6  section shall be deposited in the separate restricted account
     7  provided for in section 4(d).
     8     (d)  Calls prohibited.--No telemarketer shall make or cause
     9  to be made any unsolicited telephone sales call to any
    10  residential telephone number if that telephone number appears on
    11  the then-current quarterly list published by the Office of
    12  Attorney General.
    13     (e)  Notification.--The Office of Attorney General shall
    14  inform each local telephone company, on an annual basis, that
    15  the company is required to notify its residential customers of
    16  the opportunity to place their telephone number on the "no sales
    17  solicitation calls" list. The notification shall be made by
    18  annual inserts in the billing statements mailed to residential
    19  customers and conspicuous publication of the notice in the
    20  consumer information pages of the local telephone directories.
    21  The notification shall specify the methods by which residential
    22  customers may place their names on the list and the length of
    23  time that the numbers will remain on the list without renewal.
    24     Section 2.  This act shall take effect in 60 days.
