                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for good driver discounts.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 75 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 1799.8.  Good driver discount.
     8     (a)  General rule.--All insurance companies authorized to
     9  write private passenger automobile insurance within this
    10  Commonwealth shall provide premium discounts for good drivers.
    11  These discounts shall apply to the comprehensive coverage and
    12  shall be approved by the commissioner as part of the insurer's
    13  rate filing, provided that such discounts shall not be less than
    14  20%. Some or all of the premium discounts required by this
    15  subsection may be omitted upon demonstration to the commissioner
    16  in an insurer's rate filing that the discounts are duplicative
    17  of other discounts provided by the insurer.


     1     (b)  Definitions.--As used in this section, the following
     2  words and phrases shall have the meanings given to them in this
     3  subsection:
     4     "Good driver."  A driver who:
     5         (1)  Has been licensed to drive a motor vehicle for the
     6     past three years.
     7         (2)  Has not had more than one accident resulting in over
     8     $500 in damages during the past three years.
     9         (3)  Has not been principally at fault in any accident
    10     that resulted in death or injury during the past three years.
    11         (4)  Has not been convicted of driving under the
    12     influence of drugs or alcohol during the past seven years.
    13     Section 2.  This act shall take effect in 60 days.
