                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for action by
     3     judgment creditor.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8313.  Action by judgment creditor.
     9     (a)  General rule.--An action may be brought by a judgment
    10  creditor against an insurer of a debtor to directly enforce a
    11  final judgment for bodily injury, death or property damage
    12  subject to the policy terms and up to but not beyond the limits
    13  of the debtor's insurance policy. Such an action shall not limit
    14  the creditor's rights otherwise to seek satisfaction of the
    15  judgment or limit the liability of the insurer for acting in bad
    16  faith.
    17     (b)  Definition.--As used in this section, "final judgment"
    18  shall mean a judgment from an action in which all avenues of

     1  appeal, as of right or by permission, have been exhausted.
     2     Section 2.  This act shall take effect in 60 days.
