AN ACT 1 Amending the act of June 24, 1931 (P.L.1206, No.331), entitled 2 "An act concerning townships of the first class; amending, 3 revising, consolidating, and changing the law relating 4 thereto," further providing for certain reimbursement AND FOR <-- 5 ADDITIONAL CREDIT FOR CERTAIN CIVIL SERVICE EXAMINATIONS. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Sections 611 and 622 of the act of June 24, 1931 9 (P.L.1206, No.331), known as The First Class Township Code, 10 reenacted and amended May 27, 1949 (P.L.1955, No.569) and 11 amended January 28, 1988 (P.L.17, No.8), are amended to read: 12 Section 611. Membership of Associations; Expenses of 13 Members.--The township commissioners and other officers of the 14 township designated by the township commissioners shall attend 15 such conventions, conferences, institutes or schools whenever 16 possible. Each township officer attending such convention, 17 conference, institute or school shall receive a certificate, 18 signed by the presiding officer and secretary or acting
1 secretary of the association, attesting his presence at the 2 convention, conference, institute, or school. Such certificate 3 shall entitle him to collect from the township treasurer 4 expenses which shall be limited to the registration fee, mileage 5 for use of personal vehicle or reimbursement of actual 6 transportation expense going to and returning from such meeting 7 plus all other actual expenses that the township commissioners 8 may have agreed to pay. Every delegate attending the annual 9 meeting shall submit to the township commissioners an itemized 10 account of expenses incurred thereat. The township commissioners 11 may authorize township employes to be compensated at their 12 regular employe rate during their attendance at the annual 13 meeting. The board of commissioners solely may authorize 14 commissioners who are not employed by the township to receive 15 total or partial reimbursement for lost wages or salary while 16 attending the annual meeting. However, sufficient documentation 17 of such wages or salary must be provided to the board of 18 commissioners to justify said reimbursement. The expenses of 19 holding any such convention shall be paid pro rata by the 20 townships joining therein. 21 Section 622. Expenses of Delegates Paid by Townships.--Each 22 delegate and other officer attending the annual meeting of the 23 State association shall be allowed expenses which shall be 24 limited to the registration fee, mileage for use of personal 25 vehicle or reimbursement of actual transportation expense going 26 to and returning from such meeting plus all other actual 27 expenses that the township commissioners may have agreed to pay. 28 Every delegate attending the annual meeting shall submit to the 29 township commissioners an itemized account of expenses incurred 30 thereat. 1 employes to be compensated at their regular employe rate during 2 their attendance at the annual meeting. The board of 3 commissioners solely may authorize commissioners who are not 4 employed by the township to receive total or partial 5 reimbursement for lost wages or salary while attending the 6 annual meeting. However, sufficient documentation of such wages 7 or salary must be provided to the board of commissioners to 8 justify said reimbursement. No delegate shall receive expenses 9 for more than four days including the time employed in traveling 10 thereto and therefrom, together with mileage going to and 11 returning from the meeting. These expenses shall be paid by the 12 respective townships. 13 SECTION 2. SECTION 635 OF THE ACT, AMENDED DECEMBER 4, 1980 <-- 14 (P.L.1101, NO.188), IS AMENDED TO READ: 15 SECTION 635. GENERAL PROVISIONS RELATING TO EXAMINATIONS.-- 16 THE COMMISSION SHALL MAKE RULES AND REGULATIONS TO BE APPROVED 17 AS PROVIDED IN SECTION 630 HEREOF, PROVIDING FOR THE EXAMINATION 18 OF APPLICANTS FOR POSITIONS IN THE POLICE FORCE AND AS PAID 19 OPERATORS OF FIRE APPARATUS AND FOR PROMOTIONS, WHICH RULES AND 20 REGULATIONS SHALL PRESCRIBE THE MINIMUM QUALIFICATIONS OF ALL 21 APPLICANTS TO BE EXAMINED AND THE PASSING GRADES. ALL 22 EXAMINATIONS FOR POSITIONS OR PROMOTIONS SHALL BE PRACTICAL IN 23 CHARACTER AND SHALL RELATE TO SUCH MATTERS AND INCLUDE SUCH 24 INQUIRIES AS WILL FAIRLY TEST THE MERIT AND FITNESS OF THE 25 PERSONS EXAMINED TO DISCHARGE THE DUTIES OF THE EMPLOYMENT 26 SOUGHT BY THEM. ALL EXAMINATIONS SHALL BE OPEN TO ALL APPLICANTS 27 WHO HAVE THE MINIMUM QUALIFICATIONS REQUIRED BY THE RULES AND 28 REGULATIONS. EACH APPLICANT FOR EXAMINATION SHALL BE SUBJECT TO 29 THE REGULATIONS ADOPTED BY THE COMMISSION AND SHALL BE REQUIRED 30 TO SUBMIT TO A PHYSICAL EXAMINATION EITHER BEFORE OR AFTER BEING 19990S0707B2018 - 3 -
1 ADMITTED TO THE REGULAR EXAMINATION HELD BY THE COMMISSION. 2 PUBLIC NOTICE OF THE TIME AND PLACE OF EVERY EXAMINATION, 3 TOGETHER WITH THE INFORMATION AS TO THE KIND OF POSITION OR 4 PLACE TO BE FILLED, SHALL BE GIVEN BY PUBLICATION ONCE IN A 5 NEWSPAPER OF GENERAL CIRCULATION IN THE TOWNSHIP OR IN A 6 NEWSPAPER CIRCULATING GENERALLY IN THE TOWNSHIP AT LEAST TWO 7 WEEKS PRIOR TO EACH EXAMINATION, AND A COPY OF THE NOTICE SHALL 8 BE PROMINENTLY POSTED IN THE OFFICE OF THE COMMISSION OR OTHER 9 PUBLIC PLACE. 10 THE COMMISSION SHALL POST IN ITS OFFICE THE ELIGIBLE LIST 11 CONTAINING THE NAMES AND GRADES OF THOSE WHO HAVE PASSED THE 12 EXAMINATION. PERSONS MALE OR FEMALE WHO SERVED IN THE MILITARY 13 OR NAVAL SERVICE OF THE UNITED STATES DURING ANY WAR IN WHICH 14 THE UNITED STATES HAS BEEN, IS NOW, OR SHALL HEREAFTER BE 15 ENGAGED AND WHO HAVE HONORABLE DISCHARGES FROM SUCH SERVICE, WHO 16 HAVE SUCCESSFULLY PASSED THE EXAMINATION, SHALL BE GIVEN THE 17 ADDITIONAL CREDITS AND PREFERENCE IN APPOINTMENT AND PROMOTION 18 PROVIDED FOR BY LAW. 19 IN A TOWNSHIP SERVED BY A FIRE DEPARTMENT CONSISTING OF BOTH 20 PAID AND VOLUNTEER FIREMEN, THE GOVERNING BODY MAY PROVIDE 21 ADDITIONAL CREDIT FOR APPOINTMENT TO A POSITION AS A PAID 22 FIREMAN TO ANY APPLICANT VOLUNTEER FIREMAN WHO HAS SERVED IN 23 THAT TOWNSHIP. 24 Section 2 3.
