        INTRODUCED BY RHOADES, BELL, WILT, SHAFFER, ROCKS, SHUMAKER,
           WENGER, LEMMOND, HOLL, MADIGAN, REIBMAN, O'PAKE AND BELAN,
           APRIL 10, 1989

        AS AMENDED ON THIRD CONSIDERATION, DECEMBER 5, 1989

                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," increasing THE AUTHORIZED    <--
    21     membership of the Pennsylvania State Police; and providing     <--
    22     for enlisted personnel. AND MAKING EDITORIAL CHANGES.          <--

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  Section 205(b) of the act of April 9, 1929
    26  (P.L.177, No.175), known as The Administrative Code of 1929,
    27  amended December 28, 1972 (P.L.1649, No.349), is amended to

     1  read:
     2     Section 205.  Pennsylvania State Police.--* * *
     3     (b)  The State Police Force shall consist of such number of
     4  officers and [men] enlisted personnel, and shall be organized in
     5  such manner, as the Commissioner of Pennsylvania State Police,
     6  with the approval of the Governor, shall from time to time
     7  determine: Provided, however, That [during the fiscal year 1971-  <--
     8  1972, the number of officers and [men] enlisted personnel shall   <--
     9  not exceed in the aggregate at any time, three thousand seven
    10  hundred ninety persons, and during the fiscal year 1972-1973 and
    11  thereafter,] the number of officers and [men] enlisted personnel  <--
    12  shall not exceed in the aggregate at any time [three thousand
    13  nine hundred and forty] four thousand four hundred forty
    14  persons. State [policemen] Police, both officers and [men]
    15  enlisted personnel, assigned to duty with the Pennsylvania
    16  Turnpike Commission, shall not be counted in determining the
    17  total number of officers and [men] enlisted personnel in the
    18  State Police Force.

    20     Section 2.  This act shall take effect in 60 days.
