                                     AN ACT

     1  Amending Title 65 (Public Officers) of the Pennsylvania
     2     Consolidated Statutes, prohibiting public contracts for
     3     lobbying.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 65 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 13A07.1.  Public contracts for lobbying prohibited.
     9     (a)  General rule.--No State agency, nor any public official
    10  or employee of a State agency or public official, shall hire,
    11  retain, compensate or otherwise employ a lobbyist to attempt to
    12  influence the approval, modification or rejection of any
    13  legislative or administrative action by the executive branch of
    14  the Commonwealth or the General Assembly.
    15     (b)  Definitions.--As used in this section, the following
    16  words and phrases shall have the meanings given to them in this
    17  subsection:


     1     "Executive branch of the Commonwealth."  Any department,
     2  bureau, board, council, authority or commission of the
     3  Commonwealth, including any office under the purview of the
     4  Governor, Lieutenant Governor, cabinet member and deputy
     5  secretary that possesses the discretionary power to affect
     6  official action of a nonministerial nature.
     7     "State agency."  Any department, bureau, board, council,
     8  authority or commission of the Commonwealth, which was created
     9  by or pursuant to a statute or executive order authorizing or
    10  establishing such agency to perform a State-level governmental
    11  function. The term shall also include any school authority,
    12  school board and council of trustees of any State-owned college
    13  or university.
    14     Section 2.  This act shall take effect in 60 days.
