                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further prohibiting the sale of
     3     tobacco; and prohibiting the furnishing of free coupons for
     4     cigarettes or free samples of cigarettes.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 6305 and 6306 of Title 18 of the
     8  Pennsylvania Consolidated Statutes are amended to read:
     9  § 6305.  Sale of tobacco.
    10     A person is guilty of a summary offense if he sells tobacco,
    11  in any form, including, but not limited to, chewing tobacco and
    12  snuff, to any minor under the age of [16] 18 years, or by
    13  purchase, gift or other means, furnishes tobacco, in any form,
    14  including, but not limited to, chewing tobacco and snuff, to a
    15  minor under the age of [16] 18 years.
    16  § 6306.  Furnishing cigarettes [or], cigarette papers, coupons
    17             or samples.
    18     (a)  Offense defined.--A person commits an offense if he


     1  furnishes to any minor under the age of 18 years, by gift, sale
     2  or otherwise, any cigarettes [or], cigarette paper, free samples
     3  of cigarettes or coupons to obtain free cigarettes.
     4     (b)  Grading.--Whoever commits an offense under this section
     5  shall, upon being convicted thereof in a summary proceeding, be
     6  sentenced for the first offense to pay a fine or not exceeding
     7  $25 and for the second offense shall be fined not exceeding
     8  $100; and for the third or subsequent offense shall be guilty of
     9  a misdemeanor of the third degree.
    10     Section 2.  Title 18 is amended by adding a section to read:
    11  § 7326.  Furnishing cigarette coupons or samples.
    12     (a)  Offense defined.--A person commits a summary offense if
    13  he furnishes any person with free samples of cigarettes or
    14  coupons to obtain free cigarettes.
    15     (b)  Penalties.--A person who violates this section shall,
    16  upon conviction, be sentenced to pay a fine of not less than $50
    17  nor more than $300 or to imprisonment for not more than 90 days,
    18  or both.
    19     Section 3.  This act shall take effect in 60 days.
