AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for police animals. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Section 5511.2(d) of Title 18 of the Pennsylvania 6 Consolidated Statutes is amended to read: 7 § 5511.2. Police animals. 8 * * * 9 (d) Definitions.--As used in this section, the following 10 words and phrases shall have the meanings given to them in this 11 subsection: 12 "Accelerant detection dog." A dog which is trained for 13 accelerant detection, commonly referred to as arson canines. 14 "Bomb detection dog." A dog which is trained to locate a 15 bomb or explosives by scent.
1 "Narcotic detection dog." A dog which is trained to locate 2 narcotics by scent. 3 "Police animal." An animal, including, but not limited to, 4 dogs and horses, used by the Pennsylvania State Police, a police 5 department created by a metropolitan transportation authority 6 operating under 74 Pa.C.S. Ch. 17 (relating to metropolitan 7 transportation authorities), a police department created 8 pursuant to the act of April 6, 1956 (1955 P.L.1414, No.465), 9 known as the Second Class County Port Authority Act, THE CAPITOL <-- 10 POLICE, the Department of Corrections, a county facility or 11 office or by a municipal police department, fire department, 12 search and rescue unit or agency or handler under the 13 supervision of such department, search and rescue unit or agency 14 in the performance of the functions or duties of such 15 department, search and rescue unit or agency, whether the animal 16 is on duty or not on duty. The term shall include, but not be 17 limited to, an accelerant detection dog, bomb detection dog, 18 narcotic detection dog, search and rescue dog and tracking 19 animal. 20 "Search and rescue dog." A dog which is trained to locate 21 lost or missing persons, victims of natural or manmade disasters 22 and human bodies. 23 "Tracking animal." An animal which is trained to track or 24 used to pursue a missing person, escaped inmate or fleeing 25 felon. 26 Section 2. This act shall take effect in 60 days. H19L18SFL/20050S0895B1417 - 2 -
