AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," further providing for acquisition of 
6buildings or land.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 703 of the act of March 10, 1949 (P.L.30,
10No.14), known as the Public School Code of 1949, amended June 
1130, 2011 (P.L.112, No.24), is amended to read:

12Section 703. Acquisition of Buildings, Sites for School
13Buildings and Playgrounds, and Disposing Thereof.--(a) In order
14to comply with the provisions of this act, and subject to the
15conditions thereof, the board of school directors of each
16district is hereby vested with the necessary power and authority
17to acquire, in the name of the district, by purchase, lease,
18gift, devise, agreement, condemnation, or otherwise, any and all
19schools and real estate, either vacant or occupied, including
20lands theretofore occupied by streets and alleys which have been

1vacated by municipal authorities, and to acquire by purchase,
2lease, gift or devise, other buildings approved for school use
3by the Department of Education as the board of school directors
4may deem necessary to furnish school buildings or other suitable
5sites for proper school purposes for said district or to enlarge
6the grounds of any school property held by such district, and to
7sell, convey, transfer, dispose of, or abandon the same, or any
8part thereof, as the board of school directors may determine.
9Approval of the Department of Education shall not be required
10for school buildings and playgrounds on any school construction
11project for which State reimbursement is not requested.

12(b) Before exercising any authority to acquire land or
13buildings under this section, the superintendent of a school
14district shall notify, in writing, any municipality in which the
15land or buildings are located no less than sixty (60) days
16before taking title to the premises. The notice shall include
17the location of the land or buildings being acquired, the nature
18of the facility to be constructed or utilized, including the
19approximate number of students and employes that will be
20accommodated by the facility, and the expected development
21schedule of the project.

22Section 2. This act shall take effect in 60 days.
