SENATE BILL

           GERLACH, CORMAN, ROBBINS, PUNT AND AFFLERBACH, APRIL 21, 1997

        REFERRED TO ENVIRONMENTAL RESOURCES AND ENERGY, APRIL 21, 1997

                                     AN ACT

     1  Providing for a Statewide referendum on the question of whether
     2     Pennsylvania should have a returnable beverage container act.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Referendum placed on ballot.
     6     The Secretary of the Commonwealth shall cause to be placed on
     7  the ballot, at the primary or general election next following
     8  the effective date of this act, a referendum to determine the
     9  will of the electorate of the Commonwealth with respect to the
    10  passage of a returnable beverage container act. The referendum
    11  shall be advertised and conducted in accordance with the
    12  provisions of the act of June 3, 1937 (P.L.1333, No.320), known
    13  as the Pennsylvania Election Code.
    14  Section 2.  Form of question.
    15     The question shall be in substantially the following form:
    16         Shall the General Assembly enact legislation, to be
    17         entitled the Returnable Beverage Container Act, which
    18         will place a nominal charge on every nonbiodegradable or

     1         nonphotodegradable beverage container of 16 ounces or
     2         less sold in this Commonwealth, with the charges
     3         collected to be returned to consumers upon return of the
     4         containers to recycling centers, retailers or beverage
     5         manufacturers?
     6  Section 3.  Effective date.
     7     This act shall take effect immediately.
