SENATE BILL

                                     AN ACT

     1  Authorizing the release of Project 70 restrictions on certain
     2     lands owned by Hanover Township, Luzerne County, in return
     3     for imposition of Project 70 restrictions on other lands to
     4     be obtained by Hanover Township, Luzerne County.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Authorization.
     8     Under the requirements of section 20(b) of the act of June
     9  22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70 Land
    10  Acquisition and Borrowing Act, the General Assembly hereby
    11  authorizes the release of Project 70 restrictions from the lands
    12  described in section 2 in exchange for imposition of Project 70
    13  restrictions on the lands described in section 3 which are to be
    14  obtained by Hanover Township, Luzerne County.
    15  Section 2.  Lands to be released from Project 70 restrictions.
    16     The property of Hanover Township to be released from Project
    17  70 restrictions is as follows:
    18  ALL that certain lot, piece or parcel of land situated in the


     1  Buttonwood Section of the Township of Hanover, County of
     2  Luzerne, and more particularly bounded and described as follows,
     3  to wit:
     4  BEGINNING at a point in the southerly right-of-way line of a
     5  twelve (12) foot wide public alley more commonly referred to as
     6  Cherry Lane, said point being located along said right-of-way
     7  line North 47 degrees 13 minutes 00 seconds West 41.55 feet from
     8  the northerly most corner of that portion of lands, now or
     9  formerly of Joseph and Pauletti Lasecki more particularly
    10  described in Luzerne County Deed Book 2421 at Page 9;
    11  THENCE along lands of Earth Conservancy South 58 degrees 31
    12  minutes 00 seconds West 39.47 feet to a point;
    13  THENCE through lands of Hanover Township, by the following three
    14  (3) bearings and distances:
    15     1.  North 47 degrees 13 minutes 00 seconds West 238.42 feet
    16         to a corner;
    17     2.  South 42 degrees 47 minutes 00 seconds West 12.00 feet to
    18         a corner;
    19     3.  North 47 degrees 13 minutes 00 seconds West 44.95 feet to
    20         a point;
    21  THENCE along lands of Earth Conservancy, North 58 degrees 31
    22  minutes 00 seconds East 51.95 feet to a point in the
    23  southwesterly line of lands now or formerly of David and Carol
    24  Reese;
    25  THENCE along said line of lands and along the aforementioned
    26  southerly right-of-way line of Cherry Lane South 47 degrees 13
    27  minutes 00 seconds East 280.00 feet to the PLACE OF BEGINNING.
    28  CONTAINING 11,156 square feet (0.26) acres) of land, more or
    29  less.
    30  Section 3.  Lands to be obtained by Hanover Township on which

     1                 Project 70 restrictions are to be imposed.
     2     The property to be acquired by Hanover Township upon which
     3  Project 70 restrictions are to be imposed is as follows:
     4  ALL that certain lot, piece or parcel of land situated in the
     5  Buttonwood Section of the Township of Hanover, County of
     6  Luzerne, more particularly bounded and described as follows, to
     7  wit:
     8  BEGINNING at the westerly most corner of lands of Hanover
     9  Township, as more fully described in Luzerne County Deed Book
    10  1626 at Page 58, said corner being common to Lot 17 as shown on
    11  a proposed layout plan for Cherry Lane Subdivision, prepared by
    12  Borton Lawson Engineering and dated September 18, 1998;
    13  THENCE along Lot 17 on the aforementioned plan South 58 degrees
    14  31 minutes 00 seconds West 11.42 feet to a point;
    15  THENCE continuing along Lot 17 and also along Lot 21 of the
    16  aforementioned plan North 29 degrees 15 minutes 45 seconds West
    17  61.11 feet to a point;
    18  THENCE along Lots 22 and 23 of the aforementioned plan North 61
    19  degrees 04 minutes 00 seconds East 217.85 feet to a point in the
    20  southerly line of a proposed fifty (50) foot wide right-of-way;
    21  THENCE along said right-of-way line South 47 degrees 13 minutes
    22  00 seconds East 53.37 feet to a point in the northwesterly line
    23  of the aforementioned lands of Hanover Township;
    24  THENCE along said line of lands South 58 degrees 31 minutes 00
    25  seconds West 223.05 feet to the PLACE OF BEGINNING.
    26  CONTAINING 12,673 square feet (0.29 acres) of land, more or
    27  less.
    28  Section 4.  Restriction.
    29     Project 70 restrictions shall be imposed on the lands
    30  described in section 3 by the following deed clause:

     1         "This land is to be used for park, recreation and
     2         conservation purposes in accordance with provisions of
     3         the act of June 22, 1964 (Sp.Sess., P.L.131, No.8), known
     4         as the Project 70 Land Acquisition and Borrowing Act."
     5  Section 5.  Effective date.
     6     This act shall take effect immediately.
