                                     AN ACT

     1  Amending the act of July 10, 1986 (P.L.1238, No.114), entitled
     2     "An act amending Title 66 (Public Utilities) of the
     3     Pennsylvania Consolidated Statutes, further providing for the
     4     appointment, terms, compensation and qualifications of and
     5     restrictions on commissioners; providing for a director of
     6     operations, the Office of Trial Staff, the Office of Special
     7     Assistants and the Director of Operations and their powers
     8     and duties; further providing for procedures, reports, budget
     9     requests and audits and for rate increase requests; providing
    10     for management efficiency investigators and for fuel purchase
    11     audits; limiting recovery of certain employee meeting
    12     expenses; making provisions relating to the sale of electric
    13     generating units; providing for the regulation of excess
    14     capacity costs and new electric generating units; restricting
    15     rate setting procedures of telephone companies; requiring
    16     that certain data be supplied by electric utilities; further
    17     regulating the recovery of advertising expenses and the
    18     recovery of club dues; authorizing the commission to order
    19     conservation and load management; regulating coin telephone
    20     service; and reestablishing the Pennsylvania Public Utility
    21     Commission," further providing for sunset.

    22     The General Assembly of the Commonwealth of Pennsylvania
    23  hereby enacts as follows:
    24     Section 1.  Section 15 of the act of July 10, 1986 (P.L.1238,
    25  No.114), entitled "An act amending Title 66 (Public Utilities)
    26  of the Pennsylvania Consolidated Statutes, further providing for
    27  the appointment, terms, compensation and qualifications of and

     1  restrictions on commissioners; providing for a director of
     2  operations, the Office of Trial Staff, the Office of Special
     3  Assistants and the Director of Operations and their powers and
     4  duties; further providing for procedures, reports, budget
     5  requests and audits and for rate increase requests; providing
     6  for management efficiency investigators and for fuel purchase
     7  audits; limiting recovery of certain employee meeting expenses;
     8  making provisions relating to the sale of electric generating
     9  units; providing for the regulation of excess capacity costs and
    10  new electric generating units; restricting rate setting
    11  procedures of telephone companies; requiring that certain data
    12  be supplied by electric utilities; further regulating the
    13  recovery of advertising expenses and the recovery of club dues;
    14  authorizing the commission to order conservation and load
    15  management; regulating coin telephone service; and
    16  reestablishing the Pennsylvania Public Utility Commission," is
    17  amended to read:
    18     Section 15.  The Pennsylvania Public Utility Commission shall
    19  continue, together with its statutory functions and duties,
    20  until December 31, [1991] 1990, when it shall terminate and go
    21  out of existence unless reestablished or continued by the
    22  General Assembly for an additional [ten years] one year.
    23  Evaluation and review, termination, reestablishment and
    24  continuation of the agency beyond December 31, [1991] 1990, and
    25  every [tenth] year thereafter, shall be conducted pursuant to
    26  the act of December 22, 1981 (P.L.508, No.142), known as the
    27  Sunset Act. The performance audit of the Pennsylvania Public
    28  Utility Commission under the Sunset Act shall evaluate how
    29  effectively the commission has dealt with the needs of consumers
    30  regarding all of the following:

     1         (1)  Price.
     2         (2)  Service.
     3         (3)  Weighing of consumer input before granting any rate
     4     increase.
     5     Section 2.  This act shall take effect in 60 days.
