                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for restrictions on
     3     firearms purchases, for sale or transfer of firearms and for
     4     administrative duties of Pennsylvania State Police relating
     5     to firearms and other dangerous articles.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 18 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 6105.1.  Restrictions on firearms purchases.
    11     (a)  Offense defined.--No person, other than a licensed
    12  dealer, licensed manufacturer or licensed importer, may purchase
    13  or otherwise receive more than one firearm as defined in section
    14  6102 (relating to definitions) in this Commonwealth within any
    15  30-day period.
    16     (b)  Penalty.--Any person convicted of a violation of
    17  subsection (a) shall be guilty of a misdemeanor of the first
    18  degree.
    19     Section 2.  Section 6111(b) of Title 18 is amended by adding

     1  a paragraph to read:
     2  § 6111.  Sale or transfer of firearms.
     3     * * *
     4     (b)  Duty of seller.--No licensed importer, licensed
     5  manufacturer or licensed dealer shall sell or deliver any
     6  firearm to another person, other than a licensed importer,
     7  licensed manufacturer, licensed dealer or licensed collector,
     8  until the conditions of subsection (a) have been satisfied and
     9  until he has:

    11         (8)  Received verification from the Pennsylvania State
    12     Police that the potential purchaser, who is not a licensed
    13     dealer, licensed importer or licensed manufacturer, has not
    14     purchased a firearm as defined in section 6102 within the
    15     last 30 calendar days. Information regarding the verification
    16     of the potential purchaser described in this paragraph shall
    17     be confidential and may not be disclosed to any other person.
    18     Any such disclosure shall subject the person who disseminates
    19     the information to the penalty provided in subsection (g) and
    20     the civil penalties which are provided in subsection (i).

    22     Section 3.  Section 6111.1(b)(1) of Title 18 is amended by
    23  adding a subparagraph to read:
    24  § 6111.1.  Pennsylvania State Police.

    26     (b)  Duty of Pennsylvania State Police.--
    27         (1)  Upon receipt of a request for a criminal history,
    28     juvenile delinquency history and mental health record check
    29     of the potential purchaser or transferee, the Pennsylvania
    30     State Police shall immediately during the licensee's call or

     1     by return call forthwith:

     3             (iv)  when the potential purchaser or transferee is
     4         not a licensed importer, licensed manufacturer or
     5         licensed dealer, determine whether the potential
     6         purchaser or transferee has purchased a firearm as
     7         defined in section 6102 within the last 30 calendar days.

     9     Section 4.  This act shall take effect in 60 days.
