        SENATOR THOMPSON, APPROPRIATIONS, AS AMENDED, FEBRUARY 2, 2004

                                     AN ACT

     1  Authorizing PROVIDING FOR submission of a question to the         <--
     2     electorate pertaining to incurring certain indebtedness; and   <--
     3     provisionally authorizing the incurring of debt AUTHORIZING    <--
     4     INCURRING INDEBTEDNESS for water and wastewater treatment
     5     projects.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Short title.
     9     This act shall be known and may be cited as the Water and
    10  Wastewater Treatment Project Bond Act.
    11  Section 2.  Question of indebtedness.
    12     (a)  Authorization.--Pursuant to the provisions of section
    13  7(a)(3) of Article VIII of the Constitution of Pennsylvania, the
    14  question of incurring indebtedness of $250,000,000 for grants
    15  and loans for the acquisition, repair, construction,
    16  reconstruction, rehabilitation, extension, expansion and
    17  improvement of water and wastewater infrastructure, including
    18  water supply and sewage treatment systems, shall be submitted to


     1  the electors at the 2004 primary election.
     2     (b)  Certification.--The Secretary of the Commonwealth shall
     3  forthwith certify the question to the county boards of
     4  elections.
     5     (c)  Question.--The question shall be in substantially the
     6  following form:
     7         Do you favor the incurring of indebtedness by the
     8         Commonwealth in the amount of $250,000,000 for use as
     9         grants and loans for construction, expansion or
    10         improvement of water and wastewater infrastructure,
    11         including water supply and sewage treatment systems?
    12     (D)  ELECTION PROCEDURE.--THE ELECTION SHALL BE CONDUCTED IN   <--
    13  ACCORDANCE WITH THE ACT OF JUNE 3, 1937 (P.L.1333, NO.320),
    14  KNOWN AS THE PENNSYLVANIA ELECTION CODE, EXCEPT THAT ANY TIME
    15  LIMITS FOR ADVERTISING NOTICE RELATED TO THE QUESTION ARE HEREBY
    16  WAIVED.
    17  Section 3.  Debt to be utilized for water and wastewater
    18                 treatment projects.
    19     If the question in section 2 is submitted to the electors and  <--
    20  approved in accordance with law, the Commonwealth is authorized
    21  to incur additional indebtedness, not to exceed $250,000,000, to
    22  finance grants and loans as hereafter provided by law.
    23     PROCEEDS OF THE BORROWING, NOT TO EXCEED $250,000,000, SHALL   <--
    24  BE USED FOR LOANS AND GRANTS FOR THE ACQUISITION, REPAIR,
    25  CONSTRUCTION, EXPANSION, EXTENSION, RECONSTRUCTION,
    26  REHABILITATION OR IMPROVEMENTS OF WATER SUPPLY AND WASTEWATER
    27  INFRASTRUCTURE AS HEREAFTER PROVIDED BY LAW.
    28  Section 4.  Effective date.
    29     This act shall take effect immediately.
