        REFERRED TO STATE GOVERNMENT, OCTOBER 9, 2001

                                     AN ACT

     1  Providing for a monument in honor of United Airlines Flight 93
     2     victims; conferring powers and imposing duties on the
     3     Department of General Services; and establishing the Flight
     4     93 Victims Memorial Fund.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Flight 93
     9  Victims Memorial Act.
    10  Section 2.  Declaration of policy.
    11     The General Assembly finds and declares as follows:
    12         (1)  The magnitude and severity of the brutal terrorist
    13     attack on the United States that occurred the morning of
    14     September 11, 2001, is unprecedented.
    15         (2)  One of four civilian aircraft hijacked in the
    16     terrorist attack crashed in Somerset County, Pennsylvania,
    17     and all 45 passengers and crew members aboard that aircraft,


     1     United Airlines Flight 93, lost their lives.
     2         (3)  The aircraft crashed when passengers attempted to
     3     overcome the hijackers and prevent an act of terrorism
     4     similar to that which was inflicted upon the World Trade
     5     Center and the Pentagon.
     6         (4)  A monument commemorating the lives of the innocent
     7     passengers and crew of Flight 93 is only appropriate to
     8     express this Commonwealth's heartfelt sympathy to the
     9     families of the victims of Flight 93 and deepest appreciation
    10     to the victims themselves.
    11  Section 3.  Definitions.
    12     The following words and phrases when used in this act shall
    13  have the meanings given to them in this section unless the
    14  context clearly indicates otherwise:
    15     "Department."  The Department of General Services of the
    16  Commonwealth.
    17     "Fund."  The Flight 93 Victims Memorial Fund established in
    18  section 5.
    19  Section 4.  Duties of department.
    20     The department shall have the duty to:
    21         (1)  Erect a physical monument to memorialize and honor
    22     the innocent victims who lost their lives when United
    23     Airlines Flight 93 crashed on September 11, 2001. The
    24     monument shall be located in Somerset County, on or near the
    25     site where the crash occurred.
    26         (2)  Receive for and on behalf of the Commonwealth
    27     monetary gifts or bequests which shall be deposited in the
    28     fund.
    29         (3)  Receive for and on behalf of the Commonwealth real
    30     property upon which the monument shall be erected.

     1         (4)  Do all other things necessary or convenient to carry
     2     out the powers granted to it by this act.
     3  Section 5.  Flight 93 Victims Memorial Fund.
     4     (a)  Establishment and administration.--There is hereby
     5  established a separate fund in the State Treasury to be known as
     6  the Flight 93 Victims Memorial Fund. Money received by the
     7  department for purposes of this act shall be paid into the State
     8  Treasury and credited to the fund. The fund shall be
     9  administered by the department, and all moneys in the fund are
    10  appropriated to the department on a continuing basis.
    11     (b)  Purpose.--The moneys in the fund shall be used for the
    12  selection, design and construction of an appropriate physical
    13  monument as described under section 4 and other costs incidental
    14  thereto.
    15  Section 6.  Completion date.
    16     The monument shall be completed no later than two years
    17  following the effective date of this act.
    18  Section 7.  Effective date.
    19     This act shall take effect immediately.
