THE GENERAL ASSEMBLY OF PENNSYLVANIA

SENATE BILL

No. 1119 Session of 1999

INTRODUCED BY MELLOW, BODACK, MUSTO, WHITE, KASUNIC, COSTA AND
           BELAN, SEPTEMBER 30, 1999

REFERRED TO JUDICIARY, SEPTEMBER 30, 1999

                                     AN ACT

1 Amending Title 13 (Commercial Code) of the Pennsylvania
2 Consolidated Statutes, further providing for lien of
     3 warehouseman.

4 The General Assembly of the Commonwealth of Pennsylvania
     5 hereby enacts as follows:
6 Section 1. Section 7209(a) of Title 13 of the Pennsylvania
7 Consolidated Statutes is amended to read:
     8 § 7209. Lien of warehouseman.
9 (a) Charges and expenses covered by lien.--A warehouseman
10 has a lien against the bailor on the goods [covered by a
11 warehouse receipt] deposited or on the proceeds thereof in his
12 possession for charges for storage, processing incidental to
13 storage, or transportation (including demurrage and terminal
14 charges), insurance, labor, or charges present or future in
15 relation to the goods, and for expenses necessary for
16 preservation of the goods or reasonably incurred in their sale
17 pursuant to law. If the person on whose account the goods are
18 held is liable for like charges or expenses in relation to other

1 goods whenever deposited [and it is stated in the receipt that a
2 lien is claimed for charges and expenses in relation to other
3 goods], the warehouseman also has a lien against him for such
4 charges and expenses whether or not the other goods have been
5 delivered by the warehouseman. But against a person to whom a
6 negotiable warehouse receipt is duly negotiated the lien of a
7 warehouseman is limited to charges in an amount or at a rate
8 specified on the receipt or if no charges are so specified then
9 to a reasonable charge for storage of the goods covered by the
10 receipt subsequent to the date of the receipt.
