                                     AN ACT

     1  Amending the act of September 30, 1983 (P.L.160, No.39),
     2     entitled "An act establishing salaries and compensation of
     3     certain public officials including justices and judges of
     4     Statewide courts, judges of courts of common pleas, judges of
     5     the Philadelphia Municipal Court, judges of the Philadelphia
     6     Traffic Court, district justices and the Governor, the
     7     Lieutenant Governor, the State Treasurer, the Auditor
     8     General, the Attorney General and certain other State
     9     officers and the salary and certain expenses of the members
    10     of the General Assembly; and repealing certain inconsistent
    11     acts," further providing for judicial salaries.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 2.1 of the act of September 30, 1983
    15  (P.L.160, No.39), known as the Public Official Compensation Law,
    16  added October 19, 1995 (P.L.324, No.51), is amended to read:
    17  Section 2.1.  Judicial salaries.
    18     (a)  Supreme Court.--The annual salary of the Chief Justice
    19  of the Supreme Court shall be [$123,000] $159,313, and the
    20  annual salary of each of the other justices of the Supreme Court
    21  shall be [$119,750] $155,436.
    22     (b)  Superior Court.--The annual salary of the President

     1  Judge of the Superior Court shall be [$117,750] $153,049, and
     2  the annual salary of the other judges of the Superior Court
     3  shall be [$116,000] $150,959.
     4     (c)  Commonwealth Court.--The annual salary of the President
     5  Judge of the Commonwealth Court shall be [$117,750] $153,049.
     6  The annual salary of each of the other judges of the
     7  Commonwealth Court shall be [$116,000] $150,959.
     8     (d)  Courts of common pleas.--
     9         (1)  The annual salary of a president judge of a court of
    10     common pleas shall be fixed in accordance with the following
    11     schedule:
    12             (i)  Allegheny County, [$106,000] $139,023.
    13             (ii)  Philadelphia County, [$106,500] $139,620.
    14             (iii)  Judicial districts having six or more judges,
    15         [$105,000] $137,830.
    16             (iv)  Judicial districts having three to five judges,
    17         [$104,500] $137,206.
    18             (v)  Judicial districts having one or two judges,
    19         [$104,000] $136,549.
    20             (vi)  Administrative judges of the divisions of the
    21         Court of Common Pleas of Philadelphia County with
    22         divisions of six or more judges, [$105,000] $137,830.
    23             (vii)  Administrative judges of the divisions of the
    24         Court of Common Pleas of Philadelphia County with
    25         divisions of five or less judges, [$104,500] $137,206.
    26             (viii)  Administrative judges of the divisions of the
    27         Court of Common Pleas of Allegheny County with divisions
    28         of six or more judges, [$105,000] $137,830.
    29             (ix)  Administrative judges of the divisions of the
    30         Court of Common Pleas of Allegheny County with divisions

     1         of five or less judges, [$104,500] $137,206.
     2         (2)  The other judges of the courts of common pleas shall
     3     be paid an annual salary of [$104,000] $136,549.
     4     (e)  Philadelphia Municipal Court.--The President Judge of
     5  the Philadelphia Municipal Court shall receive an annual salary
     6  of [$103,000] $135,236. The annual salary for the other judges
     7  of the Philadelphia Municipal Court shall be [$101,250]
     8  $132,939.
     9     (f)  Philadelphia Traffic Court.--The President Judge of the
    10  Philadelphia Traffic Court shall receive an annual salary of
    11  [$55,000] $72,215. The annual salary for the other judges of the
    12  Philadelphia Traffic Court shall be [$54,500] $71,559.
    13     (g)  District justices.--A district justice shall receive an
    14  annual salary payable by the Commonwealth of [$51,500] $67,619.
    15     (h)  Senior judges.--The compensation of the senior judges
    16  pursuant to 42 Pa.C.S. § 4121 (relating to assignment of judges)
    17  shall be [$315] $418 per day. In any calendar year the amount of
    18  compensation which a senior judge shall be permitted to earn as
    19  a senior judge shall not when added to retirement income paid by
    20  the Commonwealth for such senior judge exceed the compensation
    21  payable by the Commonwealth to a judge then in regular active
    22  service on the court from which said senior judge retired. A
    23  senior judge who so elects may serve without being paid all or
    24  any portion of the compensation provided by this section.
    25     (i)  Annual cost-of-living adjustment.--Beginning January 1,
    26  1997, and each January 1 thereafter, the annual salaries under
    27  subsections (a) through (h) shall be increased by the percentage
    28  change in the Consumer Price Index for All Urban Consumers (CPI-
    29  U) for the Pennsylvania, New Jersey, Delaware and Maryland area
    30  for the most recent 12-month period for which figures have been

     1  officially reported by the United States Department of Labor,
     2  Bureau of Labor Statistics immediately prior to the date the
     3  adjustment is due to take effect. The percentage increase and
     4  salary amounts shall be determined prior to the annual effective
     5  date of the adjustment by the Supreme Court and shall be
     6  published in the Pennsylvania Bulletin by the Court
     7  Administrator of Pennsylvania within 20 days of the date the
     8  determination is made.
     9     Section 2.  This act shall take effect in 60 days.
