        INTRODUCED BY BOSCOLA, FUMO, MELLOW, O'PAKE, STOUT, MUSTO,
           KASUNIC, TARTAGLIONE, BODACK, HUGHES, LAVALLE, KITCHEN,
           LOGAN, SCHWARTZ, STACK, COSTA, WAGNER, WOZNIAK AND WILLIAMS,

                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     further providing for the Pharmaceutical Assistance Contract
     8     for the Elderly Fund; and providing for certain
     9     recommendations by the Secretary of Aging.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 508(a) of the act of August 26, 1971
    13  (P.L.351, No.91), known as the State Lottery Law, added November
    14  21, 1996 (P.L.741, No.134), is amended to read:
    15  Section 508.  Request for proposal.
    16     (a)  General rule.--The department shall prepare a request
    17  for proposal for the purpose of providing pharmaceutical
    18  assistance for the elderly within this Commonwealth. Upon the
    19  adoption of the General Fund budget, the Department of Revenue
    20  shall be authorized to transmit the appropriated funds in the


     1  State Lottery Fund to the State Treasurer to be deposited in the
     2  Pharmaceutical Assistance Contract for the Elderly Fund. This
     3  fund shall consist of appropriations and interest and shall be
     4  created by the State Treasurer to fund the operations of the
     5  program by the department and the private contractor. In
     6  addition, this fund shall consist of interest earned by moneys
     7  in the Tax Stabilization Reserve Fund, which shall be deposited
     8  on an annual basis in the fund. Funds not expended in the fiscal
     9  year in which they were appropriated shall not lapse and be
    10  available for use in the next fiscal year.

    12     Section 2.  The act is amended by adding a section to read:
    13  Section 523.  Recommendations of Secretary of Aging.
    14     Within 45 days after the annual deposit of interest from the
    15  Tax Stabilization Reserve Fund in accordance with section
    16  508(a), the Secretary of Aging shall issue recommendations to
    17  the chairman and minority chairman of the Aging and Youth
    18  Committee of the Senate and the Aging and Older Adult Services
    19  Committee of the House of Representatives on the following
    20  issues:
    21         (1)  Elimination or reduction of the deductible amount
    22     under PACENET.
    23         (2)  Extension of the PACE reinstatement provisions
    24     established under section 2305 of the act of June 26, 2001
    25     (P.L.755, No.77), known as the "Tobacco Settlement Act."
    26         (3)  Increase of participation under PACE and PACENET
    27     through a change in eligibility requirements.
    28     Section 3.  This act shall take effect in 60 days.
