                                     AN ACT

     1  Amending the act of June 10, 1931 (P.L.492, No.156), entitled
     2     "An act relating to the trespassing of live stock on improved
     3     lands; providing for the taking up, impounding and sale
     4     thereof; imposing duties on and fixing the fees of
     5     constables, justices of the peace, and viewers appointed in
     6     connection therewith; prescribing the procedure for
     7     repossession by the owner thereof; providing for the fixing
     8     and taxing of costs, including attorneys' fees; and repealing
     9     inconsistent legislation," including certain elk and red deer
    10     in definition of "live stock."

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 1 of the act of June 10, 1931 (P.L.492,
    14  No.156), entitled "An act relating to the trespassing of live
    15  stock on improved lands; providing for the taking up, impounding
    16  and sale thereof; imposing duties on and fixing the fees of
    17  constables, justices of the peace, and viewers appointed in
    18  connection therewith; prescribing the procedure for repossession
    19  by the owner thereof; providing for the fixing and taxing of
    20  costs, including attorneys' fees; and repealing inconsistent
    21  legislation," amended June 22, 2001 (P.L.581, No.40), is amended
    22  to read:

     1     Section 1.  Be it enacted, &c., That whenever the words "live
     2  stock" are used in this act, they shall include all elk or red
     3  deer on farms contained behind fences, cattle, horses, sheep,
     4  goats and swine of every age and sex, and shall include the
     5  plural as well as the singular, and whenever a singular noun is
     6  used in this act, it shall include also the plural thereof.
     7     Section 2.  This act shall take effect in 60 days.
