AN ACT
1 Amending the act of December 12, 1994 (P.L.956, No.135),
2 entitled "An act providing for humane society police
3 officers' appointment, qualifications, authority and
4 discipline; further providing for search warrants; and
5 conferring powers and duties on the Department of
6 Agriculture," further providing for the definition of
7 agricultural animal.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. The definition of "agricultural animal" in
11 section 2 of the act of December 12, 1994 (P.L.956, No.135),
12 known as the Humane Society Police Officer Enforcement Act, is
13 amended to read:
14 Section 2. Definitions.
15 The following words and phrases when used in this act shall
16 have the meanings given to them in this section unless the
17 context clearly indicates otherwise:
18 "Agricultural animal." Any elk or red deer RAISED AND <--
19 MAINTAINED WITHIN FENCES on farms contained behind fences, <--
20 bovine animal, equine animal, sheep, goat, pig, poultry, bird,
1 fowl, wild or semiwild animal or fish or other aquatic animal
2 which is being raised, kept, transported or utilized for the
3 purpose of or pursuant to agricultural production.

5 Section 2. This act shall take effect in 60 days.
