AN ACT 1 Amending Title 51 (Military Affairs) of the Pennsylvania 2 Consolidated Statutes, further defining "qualified resident"; 3 and further providing for eligibility for educational 4 assistance and for amount of educational assistance grants. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The definition of "qualified resident" in section 8 3201 of Title 51 of the Pennsylvania Consolidated Statutes is 9 amended to read: 10 § 3201. Definitions. 11 The following words and phrases when used in this chapter 12 shall have the meanings given to them in this section unless the 13 context clearly indicates otherwise: 14 * * * 15 "Qualified resident." An individual who has been a bona fide 16 resident of this Commonwealth [for a period of at least 12 17 consecutive months immediately] prior to the time an application 18 for a grant is made. 1 Assistance Agency shall make the final decision on whether an 2 applicant is a qualified resident. 3 Section 2. Sections 3202 and 3205(a) of Title 51 are amended 4 to read: 5 § 3202. Eligibility. 6 (a) General rule.--A Pennsylvania National Guard member is 7 eligible to receive a public service educational grant under 8 this chapter if the member meets all of the following 9 eligibility criteria: 10 (1) The member is a qualified resident of this 11 Commonwealth. 12 [(2) The member serves in an enlisted grade or in the 13 grade of a warrant officer 1, warrant officer 2, first 14 lieutenant or second lieutenant. 15 (3)](2) The member is a member in good standing and has 16 been a satisfactory participant in Pennsylvania National 17 Guard activities for a minimum service period established by 18 the Adjutant General. 19 [(4)](3) The member has enrolled as a student in an 20 approved program of education at an approved institution of 21 higher learning. 22 (b) Additional eligibility criteria for full-time student 23 assistance grants.--In addition to the eligibility criteria 24 specified in subsection (a), a student must meet the following 25 eligibility criteria to qualify for a full-time student 26 assistance grant: 27 (1) The member does not possess a baccalaureate degree. 28 (2) The member accepts an obligation to serve in the 29 Pennsylvania National Guard for a period of six years from 30 the date of entry into the program by enlistment, 19990S1184B1640 - 2 -
1 reenlistment, extension of enlistment or execution of a 2 service commitment. 3 (3) The member has enrolled as a full-time student in an 4 approved program of education at an approved institution of 5 higher learning. 6 (4) The member is not receiving a Reserve Officer 7 Training Corps (ROTC) Scholarship, excluding a Guaranteed 8 Reserve Forces Duty Scholarship. 9 § 3205. Amount of grants. 10 (a) Full-time student assistance grants.--Grants awarded 11 under this chapter to full-time students shall be determined by 12 the agency without regard to financial need and shall not exceed 13 for each academic year the lesser of: 14 (1) the tuition of the approved institution of higher 15 learning for the approved program of education in which the 16 member is enrolled; or 17 (2) [two-thirds of] the tuition charged to a resident of 18 this Commonwealth at a member institution of the State System 19 of Higher Education for the same academic year. 20 * * * 21 Section 3.
