SENATE BILL

        INTRODUCED BY O'PAKE, HUGHES, KASUNIC, SCHWARTZ, WAGNER, MELLOW,
           STAPLETON, BODACK, BELAN, COSTA, KITCHEN, TARTAGLIONE,
           LAVALLE, WOZNIAK, MUSTO AND BOSCOLA, DECEMBER 8, 1999

        REFERRED TO PUBLIC HEALTH AND WELFARE, DECEMBER 8, 1999

                                     AN ACT

     1  Establishing a Tobacco Settlement Advisory Committee; describing
     2     its powers and duties; and imposing duties upon the
     3     Department of Health.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Tobacco
     8  Settlement Advisory Committee Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Committee."  The Tobacco Settlement Advisory Committee
    14  created by this act.
    15     "Department."  The Department of Health of the Commonwealth.
    16     "Tobacco litigation master settlement agreement."  The master
    17  settlement agreement relating to tobacco litigation which was
    18  entered into in 1998 on behalf of the Commonwealth and leading

     1  manufacturers of tobacco products in the United States.
     2  Section 3.  Establishment.
     3     A Tobacco Settlement Advisory Committee is hereby established
     4  to advise the General Assembly concerning use of and to monitor
     5  expenditure of money received pursuant to the tobacco litigation
     6  master settlement agreement.
     7  Section 4.  Membership.
     8     The committee shall be comprised of the following 15 members:
     9         (1)  One member appointed for a four-year term by each of
    10     the following legislative leaders:
    11             (i)  The President pro tempore of the Senate.
    12             (ii)  The Minority Leader of the Senate.
    13             (iii)  The Speaker of the House of Representatives.
    14             (iv)  The Minority Leader of the House of
    15         Representatives.
    16         (2)  Nine members, each serving a two-year term,
    17     appointed by the Governor as follows:
    18             (i)  Two from the cancer research community.
    19             (ii)  Two from the field of public health.
    20             (iii)  Two health care providers.
    21             (iv)  Two representatives on behalf of health care
    22         consumers.
    23             (v)  One member of the general public.
    24         (3)  The Physician General and the Secretary of Health,
    25     or their designees, each of whom shall serve as ex officio
    26     members.
    27  Section 5.  Operation.
    28     The chairperson of the commission shall be elected by a
    29  majority vote of the members, and eight members shall constitute
    30  a quorum.

     1  Section 6.  Compensation and expenses.
     2     Members of the committee shall serve without compensation but
     3  shall be reimbursed by the department for reasonable and
     4  necessary expenditures.
     5  Section 7.  Staff.
     6     The department shall provide staff and ancillary services for
     7  the committee.
     8  Section 8.  Annual report.
     9     The committee shall file a report with the General Assembly
    10  no later than October 1 of each year, beginning October 1, 2001,
    11  containing the following:
    12         (1)  Advice of committee concerning use of moneys
    13     received pursuant to the tobacco litigation master settlement
    14     agreement.
    15         (2)  Recommendations of the committee concerning the most
    16     effective use of the moneys for the health and welfare of the
    17     citizens of the Commonwealth.
    18  Section 9.  Effective date.
    19     This act shall take effect immediately.
