SENATE BILL

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for license to carry
     3     a firearm; and making an appropriation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6109 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 6109.  Licenses.
     9     * * *
    10     (c.1)  Locking device.--When an individual applies for a
    11  license or renewal of a license to carry a firearm, the sheriff
    12  shall inform him that, for a fee, the sheriff will provide him
    13  at any time with a locking device, as defined in section 6142
    14  (relating to locking device for firearms), and written
    15  instructions on the installation and use of the device. Neither
    16  the county, the sheriff nor an employee of the sheriff's office
    17  shall be liable to any person for damages which result from
    18  misuse or malfunction of the locking device.

     2     Section 2.  The sum of $500,000 is hereby appropriated to the
     3  Pennsylvania State Police to fund the purchase and distribution
     4  of locking devices to counties. Allocations of this amount shall
     5  be based on the ratio of active licenses to carry a firearm
     6  issued in each county. Fees charged by the sheriff for a locking
     7  device shall be sufficient to ensure the purchase of more
     8  locking devices.
     9     Section 3.  This act shall take effect immediately.
