AN ACT 1 Amending Title 71 (State Government) of the Pennsylvania 2 Consolidated Statutes, further providing for credited State 3 service. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 5302(b)(2) of Title 71 of the 7 Pennsylvania Consolidated Statutes is amended to read: 8 § 5302. Credited State service. 9 * * * 10 (b) Creditable leaves of absence.-- 11 * * * 12 (2) An active member on paid leave granted by an 13 employer for purposes of serving as an elected full-time 14 officer for a Statewide employee organization which is a 15 collective bargaining representative under the act of June 16 24, 1968 (P.L.237, No.111), referred to as the Policemen and 17 Firemen Collective Bargaining Act, or the act of July 23,
1 1970 (P.L.563, No.195), known as the Public Employe Relations 2 Act, and not more than UP TO 14 full-time business agents <-- 3 appointed by an employee organization that represents 4 correction officers employed at State correctional 5 institutions: Provided, That for elected full-time officers 6 such leave shall not be for more than three consecutive terms 7 of the same office and for the UP TO 14 full-time business <-- 8 agents appointed by an employee organization that represents 9 correction officers employed at State correctional 10 institutions no more than three consecutive terms of the same 11 office; that the employer shall fully compensate the member, 12 including, but not limited to, salary, wages, pension and 13 retirement contributions and benefits, other benefits and 14 seniority, as if he were in full-time active service; and 15 that the Statewide employee organization shall fully 16 reimburse the employer for all expenses and costs of such 17 paid leave, including, but not limited to, contributions and 18 payment in accordance with sections 5501, 5505.1 and 5507, if 19 the employee organization either directly pays, or reimburses 20 the Commonwealth or other employer for, contributions made in 21 accordance with section 5507. 22 * * * 23 Section 2. The amendment of 71 Pa.C.S. § 5302(b)(2) , <-- 24 INSOFAR AS IT RELATES TO BUSINESS AGENTS APPOINTED BY AN 25 EMPLOYEE ORGANIZATION REPRESENTING CORRECTION OFFICERS AT STATE 26 CORRECTIONAL INSTITUTIONS, shall apply only to leaves of absence 27 approved after December 31, 2006, for active members who are 28 appointed as the business agents identified in section 29 5302(b)(2). 30 Section 3.
