                                     AN ACT

     1  Providing for health insurance for nontraditional Commonwealth
     2     employees.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Health
     7  Insurance for Nontraditional State Employees Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Employer."  Any of the following:
    13         (1)  The Executive Board.
    14         (2)  The Auditor General.
    15         (3)  The Attorney General.
    16         (4)  The State Treasurer.
    17     "Full-time employee."  An individual who is employed by an


     1  employer on a permanent basis for at least 1,750 hours per year.
     2     "Nontraditional employee."  An individual employed by an
     3  employer on a temporary or seasonal basis such that the
     4  individual:
     5         (1)  does not qualify as a full-time employee; but
     6         (2)  is employed for at least 1,000 hours over 40 weeks
     7     within a one-year period.
     8  Section 3.  Health insurance.
     9     Notwithstanding any statute, regulation or executive order to
    10  the contrary, an employer shall make available to nontraditional
    11  employees the same health insurance which is provided to full-
    12  time employees.
    13  Section 4.  Contracts.
    14     Section 3 shall not apply to contracts in effect on the
    15  effective date of this act but shall apply to renewals of those
    16  contracts executed on or after the effective date of this act.
    17  Section 5.  Effective date.
    18     This act shall take effect in 60 days.
