| AN ACT |
| |
1 | Amending the act of December 19, 1984 (P.L.1093, No.219), |
2 | entitled "An act relating to noncoal surface mining |
3 | conservation and reclamation," further providing for mining |
4 | permit and reclamation plan. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 7(a) of the act of December 19, 1984 |
8 | (P.L.1093, No.219), known as the Noncoal Surface Mining |
9 | Conservation and Reclamation Act, is amended to read: |
10 | Section 7. Mining permit; reclamation plan. |
11 | (a) Permit required.--Except as provided in section 24, no |
12 | person shall operate a surface mine or allow a discharge from a |
13 | surface mine unless the person has first obtained a permit from |
14 | the department in accordance with this act and unless the person |
15 | is operating in accordance with the conditions provided in the |
16 | permit as well as the applicable statutes and regulations. The |
17 | department may impose such permit conditions as are necessary to |
18 | carry out the purposes of this act. The department is authorized |
19 | to charge and collect from persons a reasonable filing fee, |

1 | which may be adjusted from time to time by regulations |
2 | promulgated by the Environmental Quality Board, and which shall |
3 | not exceed the cost of reviewing, administering and enforcing |
4 | the permit. |
