                                     AN ACT

     1  Amending the act of June 25, 1999 (P.L.205, No.27) entitled "An
     2     act authorizing the Department of General Services, with the
     3     approval of the Governor, to convey to East Allen Township,
     4     Northampton County, certain land situate in East Allen
     5     Township, Northampton County, and to convey to the trustees
     6     of the University of Pittsburgh certain land situate in the
     7     City of Pittsburgh, Allegheny County; and authorizing and
     8     directing the State Armory Board of the Department of
     9     Military and Veterans Affairs and the Department of General
    10     Services, with the approval of the Governor, to convey to the
    11     Historical and Genealogical Society of Indiana County a tract
    12     of land situate in the Borough of Indiana, County of Indiana,
    13     Pennsylvania," further providing for the purpose of the
    14     conveyance; AUTHORIZING AND DIRECTING THE DEPARTMENT OF        <--
    15     GENERAL SERVICES, WITH THE APPROVAL OF THE GOVERNOR AND
    16     DEPARTMENT OF TRANSPORTATION, TO SELL AND CONVEY TO THE
    17     BOROUGH OF HOLLIDAYSBURG CERTAIN LAND SITUATE IN THE BOROUGH
    18     OF HOLLIDAYSBURG, BLAIR COUNTY, PENNSYLVANIA; AUTHORIZING THE
    19     DEPARTMENT OF GENERAL SERVICES, WITH THE APPROVAL OF THE
    20     GOVERNOR, TO CONVEY A TRACT OF LAND IN THE BOROUGH OF
    21     SELINSGROVE, SNYDER COUNTY, TO THE EASTERN SNYDER COUNTY
    22     REGIONAL AUTHORITY IN EXCHANGE FOR ANOTHER TRACT OF LAND IN
    23     THE BOROUGH OF SELINSGROVE, SNYDER COUNTY; AUTHORIZING AND
    24     DIRECTING THE DEPARTMENT OF GENERAL SERVICES, WITH THE
    25     APPROVAL OF THE GOVERNOR, TO GRANT AND CONVEY TO SNYDER
    26     COUNTY CERTAIN LANDS SITUATE IN PENN TOWNSHIP; AUTHORIZING
    27     CONVEYANCE OF CERTAIN LANDS TO WARREN COUNTY; AND AUTHORIZING
    28     CONVEYANCE TO WARREN COUNTY OF CERTAIN LANDS SITUATE IN
    29     CONEWANGO TOWNSHIP.

    30     The General Assembly of the Commonwealth of Pennsylvania


     1  hereby enacts as follows:
     2     Section 1.  Section 1(e) of the act of June 25, 1999           <--
     3  (P.L.205, No.27) entitled "An act authorizing the Department of
     4  General Services, with the approval of the Governor, to convey
     5  to East Allen Township, Northampton County, certain land situate
     6  in East Allen Township, Northampton County, and to convey to the
     7  trustees of the University of Pittsburgh certain land situate in
     8  the City of Pittsburgh, Allegheny County; and authorizing and
     9  directing the State Armory Board of the Department of Military
    10  and Veterans Affairs and the Department of General Services,
    11  with the approval of the Governor, to convey to the Historical
    12  and Genealogical Society of Indiana County a tract of land
    13  situate in the Borough of Indiana, County of Indiana,
    14  Pennsylvania," is amended to read:

    23     SECTION 2.  SECTION 1(E) OF THE ACT IS AMENDED TO READ:

    26     (e)  Purpose.--Notwithstanding the provisions set forth in
    27  subsection (d), the deed of conveyance shall contain a clause
    28  that the land conveyed shall be used only for purposes which are
    29  compatible to the provisions under the Surplus Property
    30  Disposition Plan No. 1 of 1995 or for other municipal purposes.

     4     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
     5  THE APPROVAL OF THE GOVERNOR AND DEPARTMENT OF TRANSPORTATION,
     6  IS HEREBY AUTHORIZED AND DIRECTED ON BEHALF OF THE COMMONWEALTH
     7  OF PENNSYLVANIA TO GRANT, SELL AND CONVEY BY SPECIAL WARRANTY
     8  DEED TO BOROUGH OF HOLLIDAYSBURG FOR FAIR CONSIDERATION EQUAL TO
     9  THE FAIR MARKET VALUE AS DETERMINED BY AN INDEPENDENT APPRAISAL,

    18  OF OTHERS, INCLUDING, BUT NOT CONFINED TO, STREETS, ROADWAYS AND
    19  RIGHTS OF ANY TELEPHONE, TELEGRAPH, CABLE, WATER, ELECTRIC,
    20  SEWER, GAS OR PIPELINE COMPANIES, AS WELL AS UNDER THE SUBJECT
    21  TO ANY LAWFUL AND ENFORCEABLE INTEREST, ESTATES OR TENANCIES
    22  VESTED IN THIRD PERSONS APPEARING OF RECORD, FOR ANY PORTION OF

    24     (E)  RESTRICTIONS.--THE DEED OF CONVEYANCE SHALL CONTAIN A
    25  CLAUSE THAT THE PROPERTY CONVEYED SHALL BE USED FOR MUNICIPAL
    26  PURPOSES, AND, IF AT ANY TIME THE BOROUGH OF HOLLIDAYSBURG, OR
    27  ITS SUCCESSOR IN FUNCTION CONVEYS THE PROPERTY OR PERMITS THE
    28  PROPERTY TO BE USED FOR ANY PURPOSE OTHER THAN THAT SPECIFIED IN
    29  THIS SUBSECTION, THE TITLE TO THE PROPERTY SHALL IMMEDIATELY
    30  REVERT TO AND REVEST IN THE COMMONWEALTH OF PENNSYLVANIA.

     1     (F)  EXECUTION.--THE DEED OF CONVEYANCE AUTHORIZED BY THIS
     2  SECTION SHALL BE APPROVED AS PROVIDED BY LAW AND SHALL BE
     3  EXECUTED BY THE SECRETARY OF GENERAL SERVICES IN THE NAME OF THE
     4  COMMONWEALTH OF PENNSYLVANIA. IN THE EVENT THAT THIS CONVEYANCE
     5  IS NOT EXECUTED WITHIN 12 MONTHS OF THE EFFECTIVE DATE OF THIS
     6  ACT, OR WITHIN 12 MONTHS OF PADOT VACATING THE PREMISES,
     7  WHICHEVER IS LATER, THE PROPERTY MAY BE DISPOSED OF IN
     8  ACCORDANCE WITH ARTICLE XXIV-A OF THE ACT OF APRIL 9, 1929
     9  (P.L.177, NO.175), KNOWN AS THE ADMINISTRATIVE CODE OF 1929.
    10     (G)  GOVERNMENT APPROVALS.--GRANTEE SHALL BE SOLELY
    11  RESPONSIBLE TO OBTAIN ALL REQUIRED SUBDIVISION APPROVALS AND ALL
    12  OTHER GOVERNMENTAL APPROVALS NECESSARY FOR THE TRANSFER OR

    14  AS A RESULT OF THIS CONVEYANCE. ALL FEES AND COSTS ASSOCIATED

    17     (H)  COSTS AND FEES.--ALL OTHER COSTS AND FEES INCIDENTAL TO

    28  TRACT OF LAND DESCRIBED IN SUBSECTION (B), IN EXCHANGE FOR THE
    29  TRACT OF LAND DESCRIBED IN SUBSECTION (C).
    30     (B)  LAND TO BE CONVEYED FROM THE COMMONWEALTH.--ALL THAT

    21  CONVEYANCE SHALL BE BORNE BY THE GRANTEE.
    22  SECTION 4.3.  PENN TOWNSHIP, SNYDER COUNTY.
    23     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
    24  THE APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED
    25  ON BEHALF OF THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND
    26  CONVEY TO SNYDER COUNTY CERTAIN LAND DESCRIBED IN SUBSECTION (B)
    27  FOR FAIR MARKET VALUE AS DETERMINED BY INDEPENDENT APPRAISAL.
    28     (B)  DESCRIPTION.--THE PROPERTY TO BE CONVEYED PURSUANT TO
