AN ACT

 

1Amending Title 51 (Military Affairs) of the Pennsylvania
2Consolidated Statutes, in educational assistance program, 
3further providing for definitions; and, in educational 
4gratuity program, further providing for definitions.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. The definition of "approved institution of higher
8learning" in section 3201 of Title 51 of the Pennsylvania
9Consolidated Statutes is amended to read:

10§ 3201. Definitions.

11The following words and phrases when used in this subchapter
12shall have the meanings given to them in this section unless the
13context clearly indicates otherwise:

15"Approved institution of higher learning." An educational
16institution offering a [post-secondary] postsecondary program of
17education located in this Commonwealth and approved by the
18Pennsylvania Higher Education Assistance Agency. The term shall
 

1not include a private for-profit postsecondary educational 
2institution that awards degrees and certificates and provides 
3more than a majority of its educational programs through 
4distance learning.

6Section 2. The definition of "educational institution" in
7section 8701 of Title 51 is amended to read:

8§ 8701. Definitions.

9The following words and phrases when used in this chapter
10shall have the meanings given to them in this section unless the
11context clearly indicates otherwise:

13"Educational institution." Any college or university of the
14State System of Higher Education, a State-aided educational or
15training institution of a secondary or college grade or other
16institution of higher education, a business school, a trade
17school, a hospital school providing training for nurses, an
18institution providing courses in beauty culture, art, radio or
19undertaking or embalming, or such other educational training
20within this Commonwealth approved by the commission. The term 
21shall not include a private for-profit postsecondary educational 
22institution that awards degrees and certificates and provides 
23more than a majority of its educational programs through 
24distance learning.

26Section 3. From appropriations to it for this purpose, the
27Department of Military Affairs may continue to pay the
28following:

29(1) Tuition credit grants to members who, prior to the
30effective date of this section, received or applied for

1grants under 51 Pa.C.S. Ch. 32.

2(2) Educational gratuities to qualified children who,
3prior to the effective date of this section, received or
4applied for education gratuities under 51 Pa.C.S. Ch. 87,

5for enrollment at a private for-profit postsecondary educational
6institution that awards degrees and certificates and provides
7more than a majority of its educational programs through
8distance learning for a period not to exceed three years
9following the effective date of this section, upon the election
10of the member or the qualified child to complete the educational
11program at the private for-profit postsecondary educational
12entity.

13Section 4. This act shall take effect July 1, 2015.
