AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, in liquid fuels and fuels tax, further defining

"average wholesale price."

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  The definition of "average wholesale price" in

section 9002 of Title 75 of the Pennsylvania Consolidated

Statutes is amended to read:

§ 9002.  Definitions.

The following words and phrases when used in this chapter

shall have the meanings given to them in this section unless the

context clearly indicates otherwise:

"Average wholesale price."  The average wholesale price per

gallon of all taxable liquid fuels and fuels, excluding the

Federal excise tax and all liquid fuels taxes, as determined by

the Department of Revenue for the 12-month period ending on the

September 30 immediately prior to January 1 of the year for

which the rate is to be set. In no case shall the average

wholesale price be [less than 90¢ nor more than $1.25 per

gallon.]:

(1)  Beginning September 30, 2012, or the effective date

of this paragraph, whichever is later, through December 31,

2013, less than 90¢ nor more than $1.25 per gallon.

(2)  Beginning September 30, 2013, through December 31,

2014, less than $1 nor more than $1.50 per gallon.

(3)  Beginning September 30, 2014, through December 31,

2015, less than $1.05 nor more than $1.75 per gallon.

(4)  Beginning September 30, 2015, through December 31,

2016, less than $1.15 nor more than $2 per gallon.

(5)  Beginning September 30, 2016, through December 31,

2017 and thereafter, less than $1.25.

Section 2.  This act shall take effect September 30, 2012, or

immediately, whichever is later.
