1 COUNTY, PENNSYLVANIA; AND MAKING A REPEAL. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 Section 1. The Department of General Services, with the <-- 5 SECTION 1. CITY OF YORK, YORK COUNTY. <-- 6 (A) AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH 7 THE approval of the Governor, is hereby authorized on behalf of 8 the Commonwealth of Pennsylvania to grant and convey to Stepping 9 Stone Counseling and Education Services, Inc., the York State 10 Police Barracks, consisting of a parcel of land and building as 11 described in section 2 SUBSECTION (B) for fair consideration <-- 12 equal to fair market value as determined by independent 13 appraisal. 14 Section 2. The (B) DESCRIPTION.--THE tract to be conveyed <-- 15 is situate in the City of York, York County, Pennsylvania, 16 bounded and described as follows: 17 BEGINNING at a concrete marker set 30 feet from the center 18 line, on the Northeast side of Roosevelt Avenue, City of York; 19 thence along the city line bordering West Manchester Township, 20 North 73 degrees 22 minutes East a distance of 225.30 feet to a 21 point; thence South 8 degrees 48 minutes East a distance of 22 337.34 feet to a point; thence South 47 degrees 51 minutes West 23 a distance of 23 feet to a point; thence South 52 degrees 43 24 minutes East a distance of 128.32 feet to a point; thence North 25 37 degrees 17 minutes East a distance of 226.30 feet to a point; 26 thence North 32 degrees 27 minutes East a distance of 65.80 feet 27 to a point; thence South 74 degrees 21 minutes East a distance 28 of 81.96 feet to a point; thence South 85 degrees 18 minutes 29 East a distance of 81.96 feet to a point; thence North 83 30 degrees 45 minutes East a distance of 81.96 feet to a point; 20000S1502B2324 - 2 -

Containing a total of 7.19+/- 7 acres. Less 0.405+/- acres for the right-of-way for Fairfield 8 Drive and Laucks Place. 9 Section 3. The (C) EASEMENTS.--THE conveyance shall be made <-- 10 under and subject to all lawful and enforceable easements, 11 servitudes and rights of others, including, but not confined to, 12 streets, roadways and rights of any telephone, telegraph, water, 13 electric, cable, gas or pipeline companies, as well as under and 14 subject to any lawful and enforceable estates or tenancies 15 vested in third persons appearing of record, for any portion of 16 the land or improvements erected thereon. 17 Section 4. The (D) EXECUTION.--THE deed of conveyance shall <-- 18 be by Special Warranty Deed and shall be executed by the 19 Secretary of General Services in the name of the Commonwealth of 20 Pennsylvania. 21 Section 5. Costs (E) COSTS AND FEES.--COSTS and fees <-- 22 incidental to this conveyance shall be borne by the grantee. 23 Section 6. The (F) DEPOSIT OF PROCEEDS.--THE proceeds from <-- 24 the sale shall be deposited in the State Treasury Armory Fund, 25 established under 51 Pa.C.S. § 1511 (relating to State Treasury 26 Armory Fund), less the costs and fees incurred by the Department 27 of General Services as authorized under section 2406-A of the 28 act of April 9, 1929 (P.L.177, No.175), known as The 29 Administrative Code of 1929. 30 Section 7. 1 this conveyance is not executed within 12 months of the 2 effective date of this act, the property may be disposed of in 3 accordance with section 2406-A of the act of April 9, 1929 4 (P.L.177, No.175), known as The Administrative Code of 1929. 5 SECTION 2. HOLLIDAYSBURG BOROUGH, BLAIR COUNTY. <-- 6 (A) AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH 7 THE APPROVAL OF THE GOVERNOR AND DEPARTMENT OF TRANSPORTATION, 8 IS HEREBY AUTHORIZED AND DIRECTED ON BEHALF OF THE COMMONWEALTH 9 OF PENNSYLVANIA TO GRANT, SELL AND CONVEY BY SPECIAL WARRANTY 10 DEED TO BOROUGH OF HOLLIDAYSBURG FOR FAIR CONSIDERATION EQUAL TO 11 THE FAIR MARKET VALUE AS DETERMINED BY AN INDEPENDENT APPRAISAL, 12 THE TRACT OF LAND AND BUILDINGS DESCRIBED IN SUBSECTION (B). 13 (B) DESCRIPTION.--THE PROPERTY TO BE CONVEYED PURSUANT TO 14 SUBSECTION (A) IS THE FOLLOWING TRACT OF LAND CONSISTING OF THE 15 DEPARTMENT OF TRANSPORTATION'S BLAIR COUNTY MAINTENANCE FACILITY 16 SITUATE IN THE BOROUGH OF HOLLIDAYSBURG, BLAIR COUNTY, 17 PENNSYLVANIA, BOUNDED AND DESCRIBED AS FOLLOWS: 18 BEGINNING AT AN IRON PIN ON THE NORTHEASTERLY SIDE OF BEDFORD 19 STREET, SAID IRON PIN BEING N. 30 DEGREES 40 MINUTES W. AND 20 SIXTY-FIVE (65) FEET FROM AN ANGLE POINT IN SAID STREET; THENCE 21 BY LOT NO. 2, LAND N/F OF HOLLIDAYSBURG UNION PRAYER BAND, N. 59 22 DEGREES 20 MINUTES E. SIXTY-FIVE (65) FEET TO THE POINT OF BEGINNING. 11 CONTAINING 0.8158 OF AN ACRE, MORE OR LESS. 12 (C) CONDITION.--THE CONVEYANCE AUTHORIZED BY THIS SECTION IS 13 SUBJECT TO THE COMMONWEALTH OF PENNSYLVANIA'S COMPLETION OF A 14 NEW MAINTENANCE SHED FOR THE PENNSYLVANIA DEPARTMENT OF 15 TRANSPORTATION, HEREINAFTER REFERRED TO AS PADOT, AND PADOT 16 VACATING THE ABOVE DESCRIBED TRACT OF LAND. 17 (D) EASEMENTS.--THE CONVEYANCE AUTHORIZED BY THIS SECTION 18 SHALL BE MADE UNDER AND SUBJECT TO ALL LAWFUL AND ENFORCEABLE 19 EASEMENTS, SERVITUDES, INFRINGEMENTS KNOWN OR UNKNOWN AND RIGHTS 20 OF OTHERS, INCLUDING, BUT NOT CONFINED TO, STREETS, ROADWAYS AND 21 RIGHTS OF ANY TELEPHONE, TELEGRAPH, CABLE, WATER, ELECTRIC, 22 SEWER, GAS OR PIPELINE COMPANIES, AS WELL AS UNDER THE SUBJECT 23 TO ANY LAWFUL AND ENFORCEABLE INTEREST, ESTATES OR TENANCIES 24 VESTED IN THIRD PERSONS APPEARING OF RECORD, FOR ANY PORTION OF 25 THE LAND OR IMPROVEMENTS ERECTED THEREON. 26 (E) RESTRICTIONS.--THE DEED OF CONVEYANCE SHALL CONTAIN A 27 CLAUSE THAT THE PROPERTY CONVEYED SHALL BE USED FOR MUNICIPAL 28 PURPOSES, AND, IF AT ANY TIME THE BOROUGH OF HOLLIDAYSBURG, OR 29 ITS SUCCESSOR IN FUNCTION CONVEYS THE PROPERTY OR PERMITS THE 30 PROPERTY TO BE USED FOR ANY PURPOSE OTHER THAN THAT SPECIFIED IN 20000S1502B2324 - 5 -
1 THIS SUBSECTION, THE TITLE TO THE PROPERTY SHALL IMMEDIATELY 2 REVERT TO AND REVEST IN THE COMMONWEALTH OF PENNSYLVANIA. 3 (F) EXECUTION.--THE DEED OF CONVEYANCE AUTHORIZED BY THIS 4 SECTION SHALL BE APPROVED AS PROVIDED BY LAW AND SHALL BE 5 EXECUTED BY THE SECRETARY OF GENERAL SERVICES IN THE NAME OF THE 6 COMMONWEALTH OF PENNSYLVANIA. IN THE EVENT THAT THIS CONVEYANCE 7 IS NOT EXECUTED WITHIN 12 MONTHS OF THE EFFECTIVE DATE OF THIS 8 ACT, OR WITHIN 12 MONTHS OF PADOT VACATING THE PREMISES, 9 WHICHEVER IS LATER, THE PROPERTY MAY BE DISPOSED OF IN 10 ACCORDANCE WITH ARTICLE XXIV-A OF THE ACT OF APRIL 9, 1929 11 (P.L.177, NO.175), KNOWN AS THE ADMINISTRATIVE CODE OF 1929. 12 (G) GOVERNMENT APPROVALS.--GRANTEE SHALL BE SOLELY 13 RESPONSIBLE TO OBTAIN ALL REQUIRED SUBDIVISION APPROVALS AND ALL 14 OTHER GOVERNMENTAL APPROVALS NECESSARY FOR THE TRANSFER OR 15 INTENDED USE OF THE TRANSFERRED TRACT AND ITS BUILDINGS REQUIRED 16 AS A RESULT OF THIS CONVEYANCE. ALL FEES AND COSTS ASSOCIATED 17 WITH OBTAINING THE SUBDIVISION OR OTHER APPROVALS SHALL BE BORNE 18 BY THE GRANTEE. 19 (H) COSTS AND FEES.--ALL OTHER COSTS AND FEES INCIDENTAL TO 20 THE CONVEYANCE INCLUDING, BUT NOT LIMITED TO, APPRAISAL FEES, 21 TITLE INSURANCE, SURVEY AUTHORIZED BY THIS SECTION SHALL BE 22 BORNE BY THE GRANTEE. 23 (I) GENERAL FUND.--PROCEEDS FROM THIS SALE SHALL BE 24 DEPOSITED IN THE GENERAL FUND. 25 SECTION 3. CONVEYANCE TO EASTERN SNYDER COUNTY REGIONAL 26 AUTHORITY. 27 (A) AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH 28 THE APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED 29 TO CONVEY TO THE EASTERN SNYDER COUNTY REGIONAL AUTHORITY THE 30 TRACT OF LAND DESCRIBED IN SUBSECTION (B), IN EXCHANGE FOR THE 20000S1502B2324 - 6 -
1 TRACT OF LAND DESCRIBED IN SUBSECTION (C). 2 (B) LAND TO BE TRANSFERRED FROM THE COMMONWEALTH.--ALL THAT 3 CERTAIN TRACT OR PARCEL OF LAND SITUATE IN THE BOROUGH OF 4 SELINSGROVE, SNYDER COUNTY, PENNSYLVANIA, BEING BOUNDED AND 5 DESCRIBED AS FOLLOWS: 6 BEGINNING AT A POINT ON THE NORTHERN RIGHT-OF-WAY LINE OF 7 SANDHILL ROAD, SAID POINT BEING IN THE CENTER OF THE DESCRIBED 8 30-FOOT WIDE EASEMENT; 9 1. PENN TOWNSHIP, SNYDER COUNTY. 25 (A) AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH 26 THE APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED 27 ON BEHALF OF THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND 28 CONVEY TO SNYDER COUNTY CERTAIN LAND DESCRIBED IN SUBSECTION (B) 29 FOR FAIR MARKET VALUE AS DETERMINED BY INDEPENDENT APPRAISAL. 30 (B) DESCRIPTION.--THE PROPERTY TO BE CONVEYED PURSUANT TO 20000S1502B2324 - 8 -
