| AN ACT |
| |
1 | Authorizing the Department of General Services, with the |
2 | approval of the Pennsylvania Historical and Museum Commission |
3 | and the Governor, to grant and convey to the Erie Art Museum, |
4 | certain lands situate in the City of Erie, Erie County. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Conveyance in City of Erie, Erie County. |
8 | (a) Authorization.--The Department of General Services, with |
9 | the approval of the Pennsylvania Historical and Museum |
10 | Commission and the Governor, is hereby authorized on behalf of |
11 | the Commonwealth of Pennsylvania to grant and convey to the Erie |
12 | Art Museum a tract of land, including any improvements located |
13 | thereon, the property being known locally as the Customs House, |
14 | as described in subsection (b) for $1. |
15 | (b) Property description.--The property to be conveyed |
16 | pursuant to subsection (a) consists of approximately 0.20 acres, |
17 | including any improvements located thereon, situate in the City |
18 | of Erie, Erie County, more particularly described as follows: |
19 | The Point of BEGINNING is located South 27 degrees 00 minutes |

1 | East a distance of 82 feet 6 inches from the Northeast property |
2 | line corner at East Fourth Street and State Street, thence by |
3 | the following courses and distances; North 63 degrees 00 minutes |
4 | East and parallel to East Fourth Street for a distance of 125 |
5 | feet 0 inches to a point, on lands previously acquired by the |
6 | General State Authority, thence along Western line of said lands |
7 | South 27 degrees 00 minutes East for a distance of 70 feet 0 |
8 | inches to a point, thence South 63 degrees 00 minutes West and |
9 | parallel to the Northside of Cashiers House for a distance of |
10 | 125 feet 0 inches to a point, said point being the Northwest |
11 | corner of the above mentioned building, thence North 27 degrees |
12 | 00 minutes West and parallel to State Street for a distance of |
13 | 70 feet 0 inches to the point of BEGINNING. |
14 | BEING the same lands conveyed to the General State Authority |
15 | (predecessor to the Department of General Services) by deed from |
16 | the Commonwealth of Pennsylvania, acting by and through the |
17 | Department of Property and Supplies (predecessor to the |
18 | Department of General Services), dated March 26, 1968, and |
19 | recorded in the Erie County Recorder of Deeds Office in Deed |
20 | Book 979, Page 102. |
21 | (c) Easements.--The conveyance shall be made under and |
22 | subject to all lawful and enforceable easements, servitudes and |
23 | rights of others, including, but not confined to, streets, |
24 | roadways and rights of any telephone, telegraph, water, |
25 | electric, gas or pipeline companies, as well as under and |
26 | subject to any lawful and enforceable estates or tenancies |
27 | vested in third persons appearing of record, for any portion of |
28 | the land or improvements erected thereon. |
29 | (d) Deed restriction.--Any conveyance authorized under this |
30 | act shall be made under and subject to the condition, which |

1 | shall be contained in the deed of conveyance, that no portion of |
2 | the property conveyed shall be used as a licensed facility, as |
3 | defined in 4 Pa.C.S. § 1103 (relating to definitions), or any |
4 | other similar type of facility authorized under State law. The |
5 | condition shall be a covenant running with the land and shall be |
6 | binding upon the grantee, its successors and assigns. Should the |
7 | grantee, its successors or assigns permit any portion of the |
8 | property authorized to be conveyed in this act to be used in |
9 | violation of this subsection, the title shall immediately revert |
10 | to and revest in the grantor. |
11 | (e) Restrictive covenants.--The following restrictive |
12 | covenants shall be included in the deed of conveyance: |
13 | "Under and Subject to the condition that the buildings and |
14 | land conveyed herein shall be reasonably accessible to the |
15 | general public and maintained and preserved according to the |
16 | Secretary of the Interior's Standards for Rehabilitation and |
17 | Guidelines for Rehabilitating Historic Buildings, as revised in |
18 | 1995. Should the grantee, its successors or assigns fail to |
19 | provide reasonable access to the general public, or fail to |
20 | maintain and preserve the property as set forth herein, the |
21 | title to the property will immediately revert to and revest in |
22 | the grantor. |
23 | Furthermore, the grantee shall ensure that any design for new |
24 | construction, rehabilitation, alteration or demolition work on |
25 | the property is compatible with its original architectural |
26 | design and landscape/site plan in terms of scale, massing, |
27 | fenestration, materials and color, and is consistent with the |
28 | recommended approaches in the Secretary of the Interior's |
29 | Standards for Rehabilitation and Guidelines for Rehabilitating |
30 | Historic Buildings, as revised in 1995. |

1 | No new construction, demolition, alteration, remodeling or |
2 | landscaping/site work shall be undertaken or permitted to be |
3 | undertaken on the property without the prior, written approval |
4 | of the Pennsylvania Historical and Museum Commission, or its |
5 | successor, and signed by a duly authorized representative |
6 | thereof. |
7 | These covenants are binding on the grantee, its successors or |
8 | assigns in perpetuity." |
9 | (f) Execution of deed.--The deed of conveyance shall be |
10 | executed by the Secretary of General Services in the name of the |
11 | Commonwealth of Pennsylvania. |
12 | (g) Costs and fees.--Costs and fees incidental to this |
13 | conveyance shall be borne by the grantee. |
14 | (h) Expiration of authority.--In the event that the |
15 | conveyance is not effectuated within one year of the effective |
16 | date of this section, the authority contained in this section |
17 | shall expire. |
18 | Section 2. Effective date. |
19 | This act shall take effect immediately. |
