SENATE BILL

No. 1562 Session of 2002

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor and the Department of Public
     3     Welfare, to grant and convey certain vacant land situated at
     4     the southeast intersection of Arsenal Boulevard and North
     5     Cameron Street in the Seventh Ward of the City of Harrisburg,
     6     Dauphin County.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9  Section 1.  City of Harrisburg, Dauphin County.
    10     (a)  Conveyance authorized.--The Department of General
    11  Services, with the approval of the Governor and the Department
    12  of Public Welfare, is hereby authorized on behalf of the
    13  Commonwealth of Pennsylvania to grant and convey the tract of
    14  land bounded and described in subsection (b) for fair market
    15  value as determined by independent appraisal in accordance with
    16  an Agreement of Sale dated March 12, 2001, between the
    17  Department of General Services and Butter Krust Baking Company.
    18     (b)   Property description.--The property to be conveyed
    19  pursuant to this section consists of approximately 2.8 acres and


     1  more particularly described as follows:
     2     BEGINNING at a point, said point being located the following
     3  two courses and distances from the intersection of the Northern
     4  right-of-way line of Muench Street with the eastern right-of-way
     5  line of Cameron Street, North 15 degrees 18 minutes 31 seconds
     6  West, a distance of 307.87 feet to a point;
     7     Thence by a curve having a radius of 30.00 feet, deflecting
     8  to the right in a Northeasterly direction for a distance of
     9  26.93 feet measured along the arc of the curve, said arc having
    10  a chord bearing of north 10 degrees 24 minutes 58 seconds East,
    11  for a distance of 26.04 feet to a point, the Place of BEGINNING.
    12     Thence along lands of the Pennsylvania Department of
    13  Transportation, North 13 degrees 13 minutes 02 seconds West, for
    14  a distance of 21.65 feet to a copperweld pin;
    15     Thence continuing along the same, North 63 degrees 43 minutes
    16  12 seconds East for a distance of 37.46 feet to a copperweld
    17  pin;
    18     Thence continuing along the same South 67 degrees 09 minutes
    19  40 seconds East, for a distance of 261.40 feet to a copperweld
    20  pin;
    21     Thence continuing along the same South 49 degrees 13 minutes
    22  00 seconds East, for a distance of 68.76 feet to a copperweld
    23  pin at the corner of lands of the Pennsylvania Department of
    24  Transportation and other lands of Butter Krust Baking Company;
    25     Thence continuing along lands of Butter Krust Baking company,
    26  North 67 degrees 26 minutes 39 seconds West for a distance of
    27  309.54 feet to a point;
    28     Thence continuing along the same by a curve having a radius
    29  of 30 feet deflecting to the left in a Southwesterly direction
    30  for a distance of 40.02 feet measured along the arc of the

     1  curve, said arc having a chord bearing of South 74 degrees 20
     2  minutes 04 seconds West for a distance of 37.12 feet to a point,
     3  the PLACE OF BEGINNING.
     4     CONTAINING 7,059.00 square feet.
     5     Being a part of the same premises acquired by the
     6  Commonwealth from John Curwen, by deed dated January 31, 1879,
     7  and recorded in Dauphin County in Deed Book "Q", Volume 5, Page
     8  476; also part of the same premises acquired by the Commonwealth
     9  from Robert Graham and Annie Graham, his wife, by deed dated
    10  October 22, 1887, and recorded in Dauphin County in Deed Book
    11  "E", Volume 7, Page 404.
    12     (c)  Conditions.--The conveyance shall be made under and
    13  subject to all lawful and enforceable easements, servitudes and
    14  rights of others, including but not confined to streets,
    15  roadways and rights of any telephone, telegraph, water,
    16  electric, gas or pipeline companies, as well as under and
    17  subject to any lawful and enforceable estates or tenancies
    18  vested in third persons appearing of record, for any portion of
    19  the land or improvements erected thereon.
    20     (d)  Deed.--The deed of conveyance shall be by Special
    21  Warranty Deed and shall be executed by the Secretary of General
    22  Services in the name of the Commonwealth of Pennsylvania.
    23     (e)  Costs and fees.--Costs and fees incidental to this
    24  conveyance shall be borne by the Grantee.
    25     (f)  Alternative disposition.--In the event that this
    26  conveyance is not executed within three (3) months of the
    27  effective date of this act, the property may be disposed of in
    28  accordance with section 2406-A of the act of April 9, 1929
    29  (P.L.177, No.175), known as The Administrative Code of 1929.
    30     Section 2.  This act shall take effect immediately.
