AN ACT
Amending Title 53 (Municipalities Generally) of the Pennsylvania
Consolidated Statutes, in employees, providing for visible
badges required.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 53 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 2173. Visible badges required.
(a) General rule.--Except as provided in subsection (b), a
uniformed police officer in a county, city or other municipality
must visibly display a badge, tag or label clearly identifying
the officer at all times.
(b) Exception.--A police officer or other person empowered
to make arrests in a county, city or other municipality who is
not in uniform may not be required to visibly display a badge,
tag or label clearly identifying the individual as an officer or
other person authorized to make arrests.
(c) Effect on bail in aggravated assault cases.--

Notwithstanding 42 Pa.C.S. § 5702 (relating to bail to be
governed by general rules) or any other law or rule, if a person
is arrested under 18 Pa.C.S. § 2702 (relating to aggravated
assault) for allegedly causing bodily injury to a uniformed
police officer and the uniformed police officer was visibly
displaying a badge, tag or label clearly identifying the officer
at the time of the offense, the issuing authority shall impose a
monetary condition of release on bail in an amount of not less
than $1,000,000.
Section 2. This act shall take effect in 60 days.
