Amend Bill, page 1, line 2, by inserting after "Statutes,"
in preliminary provisions, further providing for definitions;
in Pennsylvania Game Commission, providing for marketing
expenditures; and,
Amend Bill, page 1, lines 6 and 7, by striking out all of
said lines and inserting
Section 1. Section 102 of Title 34 of the Pennsylvania
Consolidated Statutes is amended by adding definitions to read:
§ 102. Definitions.
Subject to additional definitions contained in subsequent
provisions of this title which are applicable to specific
provisions of this title, the following words and phrases when
used in this title shall have the meanings given to them in this
section unless the context clearly indicates otherwise:

"Business." As defined in 65 Pa.C.S. § 1102 (relating to
definitions).
"Business in which a commissioner or employee is associated."
A business in which a commissioner or employee of the
commission, a member of a commissioner's or employee's immediate
family or a romantic partner of a member of the commissioner's
or employee's immediate family:
(1) is a director, officer, owner, employee or
contractor;
(2) has any other financial interest; or
(3) derives a financial benefit .

"Immediate family." As defined in 65 Pa.C.S. § 1102
(relating to definitions).

Section 2. Title 34 is amended by adding a section to read:
§ 329. Marketing expenditures.
(a) Marketing plan required.--The commission may not expend
money from the Game Fund or amounts donated under section 523
(relating to donations) for marketing unless the expenditure is
made in accordance with a marketing plan that complies with this
section and is adopted under subsection (d)(3).

(b) Proposed marketing plan.--The commission may adopt a
proposed marketing plan at a meeting under section 321 (relating
to meetings of commission). The commission shall include the
goals of the marketing effort, the proposed budget and a review
of the methods of marketing that will be pursued in a proposed
marketing plan.
(c) Publication of proposed marketing plan.--Upon the
adoption of a proposed marketing plan under subsection (b) or a
revised proposed marketing plan under subsection (d)(2), the
commission shall publish the proposed marketing plan on the
commission's publicly accessible Internet website and shall
accept comments from an individual or sportsmen's organization
for a period of not less than 60 days. The commission shall
publish all comments received during the comment period on the
commission's publicly accessible Internet website and the
commission shall include a written response to each comment
received.
(d) Adoption of final marketing plan.--At the end of the
comment period under subsection (c), the commission may do any
of the following at a meeting under section 321:
(1) Withdraw the proposed marketing plan under
subsection (b).
(2) Amend the proposed marketing plan and publish the
plan in accordance with subsection (c) for an additional
comment period.
(3) Adopt a final marketing plan at a meeting under
section 321.
(e) Prohibition.--The commission may not enter into an
agreement to pay a business in which a commissioner or employee
is associated for marketing services, including a sponsorship.
Section 3. Section 522(a) and (c) of Title 34 are amended to
read:
